1. General conditions

Blokgarden.com is Blokgarden Oyj's marketplace. These terms and conditions apply in the business relationship between Blokgarden Oy and its customers. Regarding the services and products provided by Blokgarden Oy, the contract conditions defined by the respective service provider also apply. Blokgarden Oy has the right to update these terms and conditions without prior notice. Orders are subject to the terms and conditions valid at the time of order, which can be read on Blokgarden Oyj's website.

Blokgarden is not responsible for damage caused by force majeure. A force majeure is considered to be an unforeseen circumstance or a change in circumstances that is beyond Blokgarden Oy's influence. Blokgarden Oy is obliged to notify the customer of a force majeure without delay.

2. Price list

Prices include VAT, but not delivery costs unless otherwise stated. If there are clear price errors in the price list, the product will not be sold at a clearly lower price if it can be assumed that the customer has understood the existence of the error.

We always check the prices at the time of processing. When the price drops, we adjust the prices to the customer's open order. On the other hand, if the price of the product increases before the order is shipped, we will deliver them at the original price.

3. Payment

Current information on payment methods can be found on the blokgarden.com website. Please note that online payment (e-payment) with bank credentials requires the creation of a customer account.

Business customers have the opportunity to apply for billing through our business sales. You can get more information either by email at tuomas@blokgarden.com.

4. Complaint

Complaints are processed only in writing. You can submit a free form complaint either by email to team@blokgarden.com or via the contact form.

 

Resolution of disputes and place of jurisdiction: The consumer customer has the right to refer disputes arising from this contract to the Consumer Disputes Board (www.kuluttajariita.fi) to be solved. Before taking the matter to the Consumer Disputes Board, the consumer must contact the magistrates' consumer advisory service (www.kuluttajaneuvonta.fi). The consumer also has the opportunity to use the online dispute resolution forum maintained by the European Commission (http://ec.europa.eu/odr). The customer can file a lawsuit against Blokgarden Oy regarding disputes arising from the contractual debt relationship either in the district court of Blokgarden Oy's domicile or in the district court of the place in Finland in which he has his place of residence. If the Customer does not have a place of residence in Finland, disputes will be handled in the district court of Blokgarden Oy's domicile.

Attorney fees will not be reimbursed, because the Consumer Advice and Consumer Disputes Board offers free help in resolving disputes.

5. Additional conditions for business customers

Blokgarden Oy is not responsible for direct or indirect loss, damage or loss of income caused by the product and/or service. Blokgarden Oy's liability for compensation is always limited to the content of these terms and conditions. Product defect liability is limited to the possible return of the purchase price minus the utility.

Blokgarden Oy is not obliged to compensate the customer for damage or costs incurred by the customer in case of force majeure, and is entitled to cancel the contract.

By placing an order and/or request for a quote, the customer unquestionably accepts Blokgarden Oy's terms and conditions. Possible purchase contract conditions used by the customer will not be followed if they conflict with Blokgarden Oy's contract conditions.
